The Ontario government has legislated a number of unpaid leaves employees can take including a personal emergency leave of 10 days.
However, the Ontario Divisional Court recently ruled that if you have paid leave that can be taken in the same circumstances, the additional unpaid leave you can take will be reduced by the number of available paid days off.

Termination and severance pay paid to a fired executive under an employment contract complied with the Employment Standards Act. However, the Ontario Court of Justice ruled the whole employment contract was unenforceable because other parts of the standard agreement that did not apply to him violated the legislation. Therefore he was entitled to significantly higher common law damages for wrongful dismissal.
